Whereas | The vast majority of parking appeals are submitted for the primary purpose of attempting to defer payment of the fine (based on the content and context of missed appeals heard by the Parking Appeals Board); and |
Whereas | This abuse of the appeals process overloads the system, thereby causing severe delays in the processing and resolution of legitimate parking appeals; and |
Whereas | There are, indeed, legitimate parking appeals that need to be heard by the Parking Appeals Board. |
Be It Further Resolved That | A refundable parking appeals fee of $5.00 per appeal be instituted for the purpose of deterring unfounded appeals, yet not scaring away valid appeals. The $5.00 fee is high enough to achieve the deterring effect and low enough to not penalize valid appelants whose appeals are denied; and |
Be It Further Resolved That | The Parking Appeals Fee shall go solely to the parking lot maintenance fund, not to the general fund; and |
Be It Further Resolved That | In the event that an appeal is granted or voided, the appeals fee will be credited to the appellant's account. |
